Today I am reading the documents that Toyota listed on its privilege log ("Exhibit A") to see whether I think they are actually legally privileged, or if the claim of privilege is really BS and amounts to simply hiding facts.
I am not qualified to officially judge, nor will my view be accepted...but I am developing opinions.
I remember NHTSA's chief counsel, OK Vincent, telling automaker defense counsel that they "cannot hide safety defects behind privilege." I thought that was very interesting indeed, and I wonder whether Mr. Rosekind thinks that way.
