Job Description for Toyota Independent Monitor


Monitors, Receivers, Claims Administrators

In connection with its criminal and civil enforcement efforts, the United States Attorney's Office occasionally selects, or participates in the selection of, monitors, receivers, special masters, claims administrators, and similar appointments.  In some instances, depending on the circumstances and exigencies of the case, the United States Attorney's Office will solicit applications for such positions. Cases (if any) in which we are currently soliciting applications are listed below.

Independent Monitor - Toyota

The Government is soliciting applications from qualified persons to serve as independent monitor in connection with a deferred prosecution agreement entered into between the United States and Toyota Motor Corporation in the case of United States v. Toyota Motor Corporation, 14 Cr. 186 (WHP). The Independent Monitor will be selected by the United States Attorney's Office for the Southern District of New York, subject to approval by the Deputy Attorney General. As set forth at greater length in the Toyota Motor Corporation Deferred Prosecution Agreement, the Independent Monitor will (1) review and assess Toyota's policies, practices or procedures to ensure that Toyota's public statements in the United States related to motor vehicle safety are true and accurate; (2) review and assess the effectiveness of Toyota's policies, practices, or procedures for making information relating to accidents that take place in the United States available to Toyota's engineers, Toyota's chief quality officer for North America, and Toyota's regional product safety executive for North America; and (3) review and assess whether Toyota's policies, practices, or procedures regarding the generation of field technical reports–as opposed to other internal reporting mechanisms, including, but not limited to, the “intra-company communication”–in the United States ensure compliance with 49 C.F.R. Part 579. Commencing Friday, March 28, 2014, interested parties may submit a Toyota Monitor Application to USANYS-Monitor@usdoj.gov. Applications must be received by April 11, 2014.
